The AFA will be carefully monitoring the outcomes of Minister for Employment Senator Eric Abetz as he pushes for restoration to the rule of law to the building and construction industry. In a release today Senator Abetz has said that he has been aware of media reports about the spread of the culture of unlawfulness in the building and construction industry. He said there is a need for the Senate to pass legislation to re-establish the Australian Building and Construction Commission (ABCC).

The AFA feels that being aware and understanding and rectifying the situation might be two different things. During the recent ACCC investigation of the CFMEU boycott against Boral, ACCC Chairman Sims was confronted by the culture of silence and fear of reprisal that is a feature of the building and construction industry. Senator Abetz said even Labor's own inquiry into the ABCC's powers in 2009 found that that it would have been irresponsible to remove them because of the extent of unlawfulness in the building and construction industry.
